WorkSafeBC Small Business Community Terms and Conditions
The WorkSafeBC Small Business Community (the "Community") is operated by WorkSafeBC ("WorkSafeBC" or "we"). By joining the Community and becoming a Community member (a "Member") you agree to be bound by the following terms & conditions (the "Terms"):
1. Registration Requirements
In order to receive invitations to participate in Community surveys you must first register as a Member of the Community by providing us with accurate, complete and updated registration information as required by the profiling survey.
To ensure the integrity of the Community, you may not (i) activate or use more than one Member profile account; (ii) use a name subject to rights of another person without authorization from that person; or (iii) use a false or misleading name, address, or email address to activate or use an account, If we have reason to believe that you have violated any of these provisions, we reserve the right to suspend or terminate your access to use of and/or participation in the community.
You are responsible for all usage or activity on your account, including use of the account by any third party (which is prohibited), whether or not such use is authorized by you or is the result of you authorizing a third party to use your username and password.
At any time, you may update your email address and/or other registration information by visiting the Update Profile section of the Community and entering the information requested. You may also terminate your participation at any time by sending an email with the subject line "remove me" to marketresearch@worksafebc.com.
2. Community Participation
As a Member, your participation is completely voluntary, and there is no obligation for you to participate in every activity we conduct. We plan a minimum of one engagement every 3 months, noting that some activities will be targeted and not all community members will be invited to participate.
We do not guarantee any minimum number of activities and you acknowledge and agree that we are under no obligation to provide you with a particular number of opportunities to participate in activities.
3. Prohibited Uses of the Community
You explicitly agree not to do any of the following:
- Use the Community for any purpose that is unlawful or prohibited by these Terms
- Use the Community in any way that could damage, disable, overburden, or impair the Community, or interfere with anyone else's use of it
- Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Community
- Present false or misleading information to us
All commercial use (including non-personal and non-educational use) of the Community content is strictly prohibited in the absence of prior written consent of WorkSafeBC, which consent may be unreasonably withheld, and subject to such terms and conditions as WorkSafeBC may stipulate.
4. Confidentiality
Content of the activities which may include surveys and other research activities and information provided to you is proprietary and should not be published, copied or reproduced in whole or in part without our prior written consent. From time to time in the Community, we may provide you with information that is confidential or not known to the general public. Such information will be considered confidential and you will be asked not to share or use the information in any way other than as set out for Community purposes.
5. Termination of Your Access
If you breach any provision of these Terms, you may no longer access or use the Community or its content. In addition, we may terminate your right to use the Community or its content at any time, for any reason we decide, without any notice to you and without any liability to you or any other person.
If we terminate your right to use the Community, these Terms will continue to apply and be binding upon you in respect of all of the following:
- Your use of the Community prior to the termination
- Any information or materials obtained by you from the Community
- Anything connected with, relating to, or arising from, those matters
6. Disclaimer
Your use of the Community, including any links to third party content, is at your own risk. We do not warrant the quality, accuracy or completeness of any information on the Community or in any third party links, any or all of which may include inaccuracies or typographical errors. All information is provided “as is” without warranty or condition of any kind.
7. No Liability to You
We shall not be liable for any damages whatsoever arising from your use of the Community or any of its content, the non-availability of the Community, or your use of any links to third party websites, including direct, special, indirect, incidental, punitive, or consequential damages, arising out of or in connection with the use or performance of information available on the Community.
We assume no responsibility for any viruses or malware that may infect your computer as a result of your use of the Community or third party links.
8. Indemnity
You agree to defend, indemnify and hold WorkSafeBC and all of its agents, directors, employees, partners, suppliers, and affiliates harmless from any and all liabilities, costs and expenses, related to any claim or demand arising out of any violation of these Terms by you, or in connection with your use of the Community or its content.
9. General Terms
You agree to be bound by the laws of British Columbia and Canada as applicable, and any action relating to these terms and conditions or use of the Community shall be brought only in the courts in British Columbia.
If any provision of these Terms is unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability. Our failure to act with respect to a breach by you of these Terms does not constitute a waiver of our rights with respect to subsequent or similar breaches.
All information posted on the Community, including these Terms, is subject to change without notice. Your continued use of the Community after such changes is deemed to be your acceptance of such changes so please check the Terms regularly. If any changes are made to these Terms, we will revise the "Last Updated" date that is indicated on the Terms.
